“[Obama] also will ask Congress to pass laws, including ones that would:
– require universal background checks (background checks on anyone who would buy a gun, whether in stores or at auctions and conventions)”
– restore a ban on “military-style assault weapons” (the ban expired in 2004)
– ban gun magazines with capacities of more than 10 rounds
– tougher penalties on people who sell guns to people who aren’t allowed to have guns”
Universal background checks don’t just apply to auctions, conventions, and gun shows. Those would be easy. They would just need a single station to provide background checks for the entire gun show/convention/auction. However, forcing background chekcs on private transfers would really suck. Firearms could no longer be given as gifts among family members, or sold in classified ads, or traded between friends.
I’m planning to write an entire post about the idiocy of the “military style” lingo. “Asault” weapon bans are stupid. They arbitrarily ban firearms with certain cosmetic and ergomic features (such as pistol grips and adjustable stocks) as ‘bad’ while also banning other firearms with none of those features just because they were used by a military half a century ago (like the SKS or M1 Carbine). “Assault” weapon bans mainly ban rifles, but rifles were only used in 323 out of over 12,000 homicides in 2011. As discussed many times before, “asault” weapons function in the same way as traditional weapons so they are not any more or less deadly than any other semi-auto. I hate “assault” weapon bans because they’re stupid, and because I like the look/feel/customization of these modern modular rifles. It’s stupid to ban “assault” weapons, but I also recognize that it doesn’t really matter very much. I mean, traditional firearms are just as effective, so a ban doesn’t actually do anything. Self defense won’t really suffer.
Now, limiting magazine capacity is another issue. That’s one that really will make a difference, mostly for the worse. In many cases, people have needed more than 10 shots jut to stop a single attacker. If attacked by multiple people, one may need a lot of ammo. I would rather see an “assault” weapon ban than a magazine ban. I can live without a pistol grip on my rifle. I could die without enough ammo.
“tougher penalties on people who sell guns to people who aren’t allowed to have guns” Well, that could be good or bad. Blackmarket gun dealers who sell to known criminals – they need to be hit with stiff prison sentences. We need to hit criminals hard. An average fellow who accidentally sells a single gun to the wrong person – that guy deserves mercy. We need to spare those who attempt to follow the law.
